Transparency Report 2024-2025

This report covers the period 1 April 2024 to 31 March 2025 and includes requests for personal information and domain name suspensions. In previous years, this reporting was from 1 July 1 to 30 June. This year, we have adjusted the reporting period to align with our financial reporting.
The .nz domain name space is the country code top-level domain (ccTLD) assigned to Aotearoa New Zealand. It represents us on the Internet and is managed for the benefit of us all. The .nz Rules and schedules set out the rules for parties involved in the .nz domain name space.
The Domain Name Commission (DNC) enforces the .nz Rules, and InternetNZ is responsible for developing and consulting on the .nz Rules.
Under .nz Rules clause 10.2.24, DNC is committed to publishing an annual transparency report to help Registrars understand what actions we take that potentially impact users’ rights.
Under .nz Rules clause 10.2.23, we must publish on our website regular reports providing information about any requests for Withheld Data and whether they were approved or declined, unless the release would be prejudicial to the maintenance of the law.
MoUs and Agreements
As part of our multi-stakeholder approach, we enter into memorandums of understanding (MoUs) with several entities to share information and resources to collaborate with our peer country code top-level domains and to assist with maintaining the security, stability and resilience of .nz.

Sharing information with third-party agencies
We will share information, which may include personal information, when we are permitted or required by law in accordance with the .nz Rules, which state:
Under clause 1.6, the laws of New Zealand apply to these .nz Rules. The lawful instructions of the courts and the authorities made as part of due process will be complied with.
Regulators, law enforcement agencies, and some Government agencies may request information, which may include personal information such as domain name audit history or registration information from time to time.
For example, we will require a formal order or request to be made under the relevant legislation the requestor is acting before any information is provided if we hold that information.

Warrant and court orders
Under .nz Rules clause 1.6, the laws of New Zealand apply to these .nz Rules. The lawful instructions of the courts and the authorities made as part of due process will be complied with.

No court orders have been served on DNC. In addition, we have not been named a respondent in any Court proceedings, including proceedings relating to the Harmful Digital Communications Act.
Privacy Act requests
As a New Zealand-based organisation with charitable status, we are subject to the Privacy Act 2020 (New Zealand legislation). We may be subject to requests for information from third parties under principle 11(e) of the Privacy Act, which permits the release of information in certain circumstances.

Domain name suspensions
Under .nz Rules clause 12.2.15, we must not suspend or cancel a .nz domain name under clause 12.2.8. unless we determine (among other things) that:
a. the Register data for that .nz domain name is incorrect and we have made more than one attempt to contact the domain name holder.

Zone data file releases
Under .nz Rules clause 10.2.32, we may release the zone file in certain circumstances upon request.

Under .nz Rules clause 10.2.4., any person can request the information withheld from a Query Search (Withheld Data) by applying in the manner specified.
